State CIF Federated Council Meeting Report - 2009.11.02

Highlights of the Federated Council Meeting held November 2, 2009 in Ontario


I. OPENING BUSINESS

D. Adopt Agenda
It was moved, seconded, and passed to adopt the agenda with the following changes: Add item V.C.3.e Golf Advisory Committee Report. PASSED

E. Public Comments

3. General Public
Stuart Payne and Rudy Johnson spoke to the Council regarding what they termed a crisis of leadership in the San Diego Section. They and a parents group of around 100 have taken issue with eligibility rulings that have been made by the section commissioner. They have asked the San Diego Board of Managers to conduct an independent investigation and that the section commissioner and assistant commissioner resign. The Board has announced that such an investigation will take place.

III. CONSENT CALENDAR
Under this item, the Council, in one motion, will recommend matters determined to be routine by the Executive Committee for approval by the Council. Any Federated Council Representative may ask for an item to be considered separately.

A. Federated Council President  Mike Henson made mention of the following items:
1. Scholar Athlete Day
2. NFHS Summer Meeting, Chicago, IL  It was announced that Robert Kanaby, NFHS Executive Director, would be retiring in April or May, 2010.
3. NFHS Section 7/8 Conference, Kona, HI

B. Executive Director  Marie Ishida made mention of the following items:
1. Reimbursement Guidelines
2. Approved Foreign Exchange Programs Update List  This information will always be available on the web site.
3. Multi School Applications  a list of approved applications was given.
4. Schedule of Meetings, 2009-10
5. Federated Council Representatives, 2009-10
6. Update on CIF Office Relocation
a. Introduction of new staff present  Quwan Spears, Sports Information Officer, was introduced.

V. MANAGEMENT SERVICES

A. Action Items Presented For Approval By The Council.

1. CIF Budget, 2009-10 Revisions H. Daims
A revised budget for 2009-10 was presented to the Federated Council for review and approval. In addition, the following items were discussed:
a. Budget Notes
b. Investment Balances
c. Actuarial for retiree health benefits
d. Financial Procedures Manual
PASSED (unanimous)

2. Revised Weighted Voting for 2009-10 per Article 1.103 M. Henson
The weighted voting per section has been revised to reflect changes. The only change was an increase for the Los Angeles Section of one vote. For the first time CIF membership numbers over 1492 schools. PASSED (unanimous)

3. Article 32: Allied Organizations Revision K. Wheeler
Revisions were recommended to help ensure better communication not only with the CIF Federated Council, but within each organization. PASSED (unanimous)

4. Master Plan for the addition of state and regional championships R. Odom
After several recommended revisions by the commissioners and executive committees, this item was forwarded for action. PASSED (unanimous)

5. Bylaw 3101: 40 Match Rule Revision D. Regalado
This revision establishes statewide penalties when there is a violation. PASSED (unanimous)

6. Request for CIF to pilot a three-year study to allow the use of the A-11 Offense R. Odom
Piedmont High School haD requested to be allowed to pilot for three years the continued use of the A-11 offense which now has been rendered illegal under the new revised NFHS Football Rules. DENIED (unanimous)

7. NFHS/CIF Sanctioning Procedure J. Cardoza
The NFHS revised its sanctioning procedures too late for the revisions to come to the Federated Council last May. Since the CIF follows these procedures for interstate and international competition these revisions needED to be formally approved. PASSED (unanimous)

B. Items Presented For a First Reading and Discussion

The co-chairs brought the Council up to date on the meetings of the task force.

It was duly noted that the authorization that allows the State CIF to manage high school athletics is once again up consideration by the California State Legislature. It is known that there are forces in the Legislature that would change the way we operate should we not take the initiative and offer our own solutions to the problems we face. We have made a start, and it is only a start, with the implementation of the state-wide hardship procedure. However, all of us know that there is much to be done and only a year and a half before our next report and request for reauthorization goes to the State.
2. Legal Expenses, 2004-2009 Sister Milner
A discussion was held about the increasing costs of legal/litigation and the resultant effect on insurance premiums.
a. Legal chart, 2004-09  excess revenues from championship events have been used to defray these costs to the schools. However, litigation costs have now exceeded seven figures.
b. Insurance premiums, 2009  it was extremely difficult to find a Directors & Officers Insurance policies for this year. The State CIF cannot operate without such a policy.

3. Transfer Eligibility Data, 2007-09 R. Spears
The transfer eligibility data was reviewed by the Council and a discussion was held with regards to trends, recommended changes and/or revisions.

4. CIF Appeal Panel Data, 2007-09 R. Spears
The CIF Appeal Panel data was reviewed with the Council and a discussion was held with regards to trends, recommended changes, and/or revisions.

5. Bylaw 502 Revision R. Spears
The Sac Joaquin Section is proposing revision of this bylaw to allow schools in these types of situations the ability to be placed in a league. For example, a school with but three golfers could disband their team and allow the three to play for another school. That team would not be allowed to compete for the league championship nor would it be allowed to play in a section championship. Only the individual golfers could advance to league or section play.

C. Reports, Recommendations and Additional Items Presented As First Reading Items
Several committees and action teams may wish to report at this time. Also, this is a time where staff members may report on matters under their supervision and direction.

Participation numbers are up even though the nations economy is not.
b. CIF Report to the Legislature R. Blake
Members are urged to go to the State CIF web site and download this report. The first 25/30 pages of the 125 report should be read.

d. Allied Organizations C. Cunningham
The several allied organizations met for lunch and discussed the aims and direction of the Governance Task Force. This was a good meeting with very frank discussions.

2. Committees

a. Executive Committee M. Henson
This committee intends to establish a timeline for governance implementation.
b. Presidents Advisory Council M. Henson
The Council will be looking for nominees for president-elect.
c. Legislative M. Ishida
No one thought that AB 1025 (Conway) would pass, much less that the Governor would sign it. However, now that it has passed everyone is wondering what the implications are and how our costs will be affected.
d. Economic Viability/Marketing H. Daims
e. Commissioners Committee J. Crichlow

3. Sports Advisory Committees
a. CC/Track R. Alvarado
The 2009 and 2010 State Meets will be held at Woodward Park in Fresno. This years meet will be on Saturday, November 28. Chip timing, with Nikes help, will be used in this years meet.
b. Football R. Odom
The Committee is looking into a Mercy Rule that would become active once there is a difference in score of 35 points. Thirty-seven of fifty states have such a rule.
c. Volleyball D. Miller
To save money, this meeting was conducted by teleconference. The 2009 State Championships will be held at UC Irvines Bren Center. The event will travel to the San Jose Events Center for the 2010-2011 year.
d. Wrestling D. Regalado
Penalties for weigh-in infractions were proposed. Discussions concerning advancing alternates, the summer NFHS meeting, a divisional format (opposed by 90%), and a girls wrestling update took place.
e. Golf K. Wheeler
The State Championship Meet will take place at Poppy Hills on November 19.
